Terms & Conditions

By downloading or using HazScan (“the App”), you agree to the following terms. If you do not agree, do not use the App.

1. Nature of the App

HazScan is an unofficial, independent reference tool that provides information from the 2024 Emergency Response Guidebook (ERG). It is intended to assist with the initial identification of hazardous materials during the first few minutes of a transportation incident.

2. Not a substitute for professional judgment

The App is not a substitute for:

  • Emergency response training or certification
  • The current printed Emergency Response Guidebook
  • Direct contact with the shipper, CHEMTREC (1-800-424-9300), CANUTEC (1-888-226-8832), or SETIQ (01-800-002-1400)
  • Guidance from qualified hazardous materials response personnel
  • Any federal, state, provincial, or local regulations

Always verify information provided by the App against official sources before making response decisions.

3. No affiliation

HazScan is not affiliated with, endorsed by, sponsored by, or produced by the U.S. Department of Transportation (USDOT), the Pipeline and Hazardous Materials Safety Administration (PHMSA), Transport Canada (CANUTEC), the Secretariat of Communications and Transport of Mexico (SCT), or any government agency.

4. Accuracy and limitations

While we strive to ensure the accuracy of the ERG data included in the App, we make no warranties or representations regarding:

  • The completeness or accuracy of the bundled database
  • The reliability of camera-based placard recognition under all conditions (lighting, angle, weather, placard condition, obstruction)
  • The identification of any specific hazardous material or its properties

OCR-based recognition is inherently imperfect. The App may produce incorrect readings, fail to detect placards, or misidentify hazard classes. Never rely solely on the App for hazard identification.

5. Assumption of risk

You acknowledge that hazardous materials response is inherently dangerous. You assume all risk associated with the use or misuse of information provided by the App. The App is provided as a supplementary reference only.

6. Limitation of liability

To the maximum extent permitted by applicable law, Tyler Brundage and any contributors to the App shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the App
  • Any errors, inaccuracies, or omissions in the App’s data or recognition results
  • Any decisions made or actions taken based on information provided by the App
  • Any personal injury or property damage related to the use of the App

7. Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. ERG data

The Emergency Response Guidebook content included in the App is derived from the 2024 ERG, a publication jointly produced by the U.S. Department of Transportation, Transport Canada, and the Secretariat of Communications and Transport of Mexico. This content is public-domain reference material. The ERG is updated periodically; the App may not reflect the most current edition at all times.

9. Permitted use

You may use the App for lawful purposes related to hazardous materials identification, emergency response reference, training, and education. You may not reverse-engineer, decompile, or disassemble the App except as permitted by applicable law.

10. Updates

We may update the App or these terms at any time. Continued use of the App after changes to these terms constitutes acceptance of the updated terms. We are under no obligation to provide updates, support, or maintenance.

11. Governing law

These terms shall be governed by and construed in accordance with the laws of the United States and the state in which the developer resides, without regard to conflict of law provisions.
